1. Introduction and Acceptance of Terms
These Terms of Service (“Terms”) govern your use of the website, mobile applications, and related services provided by MyAirAdvocate (“we,” “us,” or “our”).
By accessing or using MyAirAdvocate, submitting a claim, or creating an account, you agree to be legally bound by these Terms and our Privacy Policy.
If you do not agree, you must not use our services.
MyAirAdvocate provides flight-compensation and travel-rights assistance for passengers affected by flight delays, cancellations, or lost luggage, along with affiliate travel content and related marketing communications.
2. Definitions
“Customer” means any individual submitting a claim or using our site or app.
“Claim” means any request for financial compensation against an airline for flight disruption or related losses.
“Assignment Agreement” means your digital authorization granting MyAirAdvocate the legal right to act as assignee of your claim.
“Service Fee” means the 25% fee retained by MyAirAdvocate from recovered compensation.
“Compensation” means any payment, voucher, or other value received from an airline as a result of MyAirAdvocate’s efforts.
“AH Signature Equivalent” means your electronic acceptance of these Terms and submission authorization through a digital checkbox or button.
“Services” means all MyAirAdvocate activities, including claim filing, affiliate content, marketing communications, and account dashboards.
3. Scope of Services
MyAirAdvocate assists air passengers in pursuing compensation under applicable air-passenger rights laws (e.g., U.S. Department of Transportation rules, EU Regulation 261/2004, U.K.261).
We provide:

Claim preparation and submission to airlines;

Communication and negotiation with carriers;

Secure customer dashboards for claim tracking;

Travel-related content and affiliate offers;
-
Marketing emails and service notifications.
We are not a law firm and do not provide legal representation or advice. Where necessary, MyAirAdvocate may work with third-party attorneys or partners.
4. Eligibility and Registration
You must be at least 18 years old and legally capable of entering into binding contracts.
You agree to provide accurate, complete information when creating an account or submitting a claim.
Each customer may maintain only one account.
5. Claim Submission and Review
Upon claim submission, MyAirAdvocate performs an automated eligibility screening based on flight data and compensation regulations.
Claims that appear eligible will be manually reviewed within approximately five (5) business days.
MyAirAdvocate may request additional documentation (e.g., boarding passes, booking confirmations).
We reserve the right to accept or decline any claim at our discretion, including cases involving extraordinary circumstances such as weather or air-traffic control restrictions.
Customers will be notified by email whether their claim has been accepted or declined.
6. Assignment of Rights and Authorization
By submitting a claim, you authorize MyAirAdvocate to:

Act as your assignee and representative for the purpose of pursuing your claim;

Communicate directly with the airline or its representatives; and

Receive compensation directly from the airline on your behalf.
Your authorization is confirmed through your digital consent (checkbox or button).
This authorization remains valid until the claim is resolved or withdrawn.
If the airline pays you directly after assignment, you agree to promptly inform MyAirAdvocate and remit our 25% Service Fee.
7. Service Fees and Payments
MyAirAdvocate operates on a no-win, no-fee basis

If no compensation is obtained, you owe nothing.
If compensation is obtained, MyAirAdvocate retains 25% of the recovered amount as the Service Fee.
The remaining 75% is paid to you via PayPal or ACH bank transfer, according to your chosen method.
You are responsible for providing accurate payment details. MyAirAdvocate is not liable for failed or delayed transfers caused by incorrect or incomplete information.
If payment is received by you directly from the airline, you authorize MyAirAdvocate to invoice you for its fee.
8. Affiliate Content and External Links
Our website and app may contain affiliate links, promotional content, or references to third-party services (e.g., airlines, hotels, or insurance partners).
MyAirAdvocate is not responsible for the content, accuracy, or availability of any third-party sites and does not guarantee any products or services offered by third parties.
Participation in any affiliate offer is voluntary and subject to the third party’s own terms.
9. Communications and Marketing
By using our services, you agree to receive:

Service communications (claim updates, account notices); and

Promotional emails about travel, affiliate offers, or company news.
You may unsubscribe from marketing emails at any time by following the instructions in each message.
Service communications related to active claims are mandatory and cannot be unsubscribed from.
10. Data Protection
Your privacy is important to us. All data processing is governed by our Privacy Policy.
By using our services, you consent to that processing.
11. No Guarantee and Limitation of Liability
MyAirAdvocate makes no guarantee of claim success or compensation amount.
We are not liable for:

Airline decisions or failures to respond;

Data inaccuracies from third parties;

Technical issues or delays beyond our control.
To the maximum extent permitted by law, MyAirAdvocate’s total liability to any user shall not exceed the Service Fee earned from that user’s claim.
12. Dispute Resolution and Class Action Waiver
All disputes arising under these Terms shall first be attempted to be resolved amicably.
If no resolution is reached, the dispute shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration shall take place in Hartford County, Connecticut.
The arbitrator’s award shall be final and may be entered in any court of competent jurisdiction.
Class Action Waiver:
You and MyAirAdvocate agree that any arbitration or proceeding shall occur only on an individual basis. You waive the right to participate in any class, collective, or representative action against MyAirAdvocate.
13. Termination
Either party may terminate a claim or account at any time by written notice.
Termination does not affect accrued rights, including fees owed for completed claims.
14. Changes to These Terms
MyAirAdvocate may modify these Terms at any time.
The updated version will be posted at https://myairadvocate.com/terms with a revised effective date.
Your continued use of our services after changes take effect constitutes acceptance of the new Terms.
15. Governing Law
These Terms are governed by and construed under the laws of the State of Connecticut, USA, without regard to conflict-of-law principles.
