Virgin Atlantic cancelled your client’s flight — what they’re owed

Written for travel agents by Nathan Zarcaro, founder of MyAirAdvocate · Updated August 2026

If Virgin Atlantic cancelled your client’s flight with under 14 days’ notice and the re-route missed the Article 5(1)(c) windows, they’re owed £520 per passenger under UK261 — nearly every Virgin flight is long-haul, so nearly every claim is the top band. That includes flights from the US into Heathrow: Virgin is a UK carrier. CEDR is the free escalation.

QUALIFY IT

Does it qualify?

Notice first. Under 7 days: owed, unless the re-route left within an hour of the original and landed under two hours late. 7–13 days: two hours early, four late. 14 days or more: no compensation; refund or rebooking still owed.

Direction: Virgin is a UK carrier, so a cancelled JFK–LHR or LAX–LHR qualifies under UK261 just as the outbound does. Agents skip inbound Virgin claims constantly. Don’t.

Codeshares: a VS flight number on Delta metal is Delta’s flight — and inbound on Delta is not covered. The “operated by” line on the e-ticket decides it.

THE MONEY

What is it worth?

Under 1,500 km

£350

1,500–3,500 km

£520

Over 3,500 km

Per passenger, measured on the journey’s great-circle distance.

Over 3,500 km £520 per passenger — that’s the Virgin table, near enough. Only the handful of routes under 3,500 km (Heathrow–Tel Aviv, some Caribbean legs by routing) fall to £350. A family of four on a cancelled Orlando flight is £2,080.

THE PUSHBACK

What Virgin will say

Virgin’s cancellations are aircraft-availability stories: a 787 grounded for the Trent engine inspections, a swap that couldn’t be made. Technical faults are not extraordinary (Wallentin-Hermann); a fleet-wide inspection programme is a known maintenance obligation, not a bolt from the blue. Push on this; Virgin knows it loses at CEDR.

Weather at Heathrow is the honest defence when it’s true. Ask for the operational report and the date the cause applied.

THE EDGE

What’s specific to Virgin Atlantic

Virgin’s online compensation form is the channel; it issues a case reference. Keep it — Virgin’s customer relations answers by reference, not by name.

CEDR membership: after refusal or 8 weeks, free binding arbitration. Referencing CEDR in the escalation line changes Virgin’s replies.

Nearly every Virgin claim is £520. Quote it with confidence; the band question that complicates BA short-haul doesn’t exist here.

Inbound from the US on Virgin metal qualifies. This is the highest-value under-claimed category for US-based agents.

Reading this as the passenger, not the agent? The plain-English version for your own trip: what to do when your flight is cancelled.

THE PLAY

How do you file it?

1

File through Virgin Atlantic’s compensation form, every passenger on the booking.

2

Attach the confirmation and the cancellation notification; name the operating carrier.

3

Diary eight weeks. Refusal or silence: open a CEDR case.

AGENTS ASK

Questions agents ask

Cancelled JFK–LHR on Virgin — does UK261 apply from a US airport?

+

Yes. Virgin is a UK carrier, so arrivals into the UK are covered.

Virgin re-routed them on Delta the same evening. Still claimable?

+

Yes, unless the Delta arrival fit the notice window — a same-evening re-route landing more than two hours late still pays.

Upper Class — more compensation?

+

No. £520 per passenger regardless of cabin. A fare-difference refund is separate if downgraded.

The cancellation was for the 787 engine inspections — extraordinary?

+

Virgin will say so. Maintenance obligations are inherent to operating aircraft, which is what Wallentin-Hermann excludes. Winnable.

Can the agency file?

+

Yes, as correspondent with written authorization.
